PROMOTIONAL TERMS AND CONDITIONS

1. These Promotional Terms apply to any giveaway, sweepstakes, gift-with-purchase, discount, or other promotional offer made by Breville USA, Inc. and its affiliates (each, a “Promotion”). By submitting a claim, entry, or request under a Promotion, the participant accepts these Promotional Terms, along with Breville's Terms of Use and Sale and Privacy Notice.
2. Breville USA, Inc., 19400 S. Western Ave., Torrance, CA 90501-1119, together with its affiliates, is the promoter of each Promotion unless stated otherwise in the applicable offer.
3. Each Promotion begins and ends on the dates and times stated in the applicable promotional materials. Claims or entries received outside the stated promotional period are void.
4. Unless the applicable Promotion expressly states otherwise: only one Promotion may be redeemed at a time; Promotions may not be combined with other coupons, discounts, promotional codes, or offers; and Promotions are non-transferable, cannot be redeemed for cash or credit, cannot be used to purchase gift cards, and cannot be applied to prior orders.
5. Breville may modify, suspend, or cancel a Promotion, including the promotional period, at any time to the extent permitted by law.
6. To be eligible, a participant must be at least 18 years old, a legal U.S. resident, and an end-user consumer participating for personal use and not for resale, commercial use, or any indirect purpose.
7. Promotions are void outside the territory identified in the applicable offer and where prohibited, taxed, or restricted by law. All applicable federal, state, and local laws and regulations apply. Each sweepstakes or giveaway Promotion will be conducted in compliance with applicable registration, bonding, and filing requirements where required by law.
8. These Promotional Terms apply to online orders and online entries submitted through the site or sites identified in the applicable offer, except where a specific Promotion expressly provides different submission instructions or an alternative means of participation. For sweepstakes, the applicable official rules or individual promotional terms will provide an alternative method of entry where required by applicable law. Participants must provide all required information requested by Breville in order to submit a valid claim or entry.
9. Breville may reject, invalidate, disqualify, or cancel any claim or entry that does not comply with these Promotional Terms or the applicable Promotion materials, or that Breville reasonably believes is unauthorized, improper, fraudulent, or affected by system error or other unforeseen problems. Breville's decisions are final to the extent permitted by law.
10. If a promotional code is provided, it must be entered at checkout as instructed. Unless the applicable Promotion states otherwise, code-based discounts apply before shipping, handling, and sales tax, apply only as described in the offer, and may be redeemed once per customer.
11. If a Promotion includes a product, gift, or other item and that item becomes unavailable, Breville may substitute an item of comparable value and quality in its discretion. Claims may be processed or fulfilled by third parties, and Breville is not responsible for third-party processing or delivery delays. Unless a specific Promotion states otherwise, employees of Breville and its promotion agencies, their immediate family members, and persons living in the same household are not eligible.
12. Breville and its agents may collect and use personal information to administer a Promotion, verify eligibility, fulfill promotional benefits, communicate with participants regarding their claims or entries, and comply with legal obligations, all in accordance with Breville's Privacy Notice. Personal information may be shared with affiliates, service providers, contractors, promotion partners, and governmental authorities as necessary for those purposes.
13. Participants are responsible for any costs of making a claim or entry and for any taxes arising from participation in or receipt of a promotional benefit.
14. Breville does not guarantee the availability of its websites or online services and is not responsible for service interruptions affecting participation.
15. To the maximum extent permitted by law, and subject to any non-waivable consumer rights, Breville excludes liability for personal injury and for any direct, indirect, incidental, special, or consequential loss or damage arising out of or in connection with a Promotion, including technical failures, third-party acts or omissions, theft, unauthorized access, or third-party interference. By participating in a Promotion, each participant, to the fullest extent permitted by law, releases, discharges, indemnifies, and holds harmless Breville, its affiliates, and each of their respective officers, directors, employees, agents, contractors, promotion partners, and representatives from and against any and all claims, liabilities, damages, losses, and causes of action arising out of or relating to the Promotion or the participant's participation in it, except to the extent caused by Breville's gross negligence, willful misconduct, or other liability that cannot lawfully be excluded or limited. Nothing in these Promotional Terms excludes, restricts, or modifies any rights or remedies that cannot lawfully be excluded, restricted, or modified.
